TERMS & CONDITIONS

TERM:

The Member agrees not to hold the LIYC responsible for any loss, damage, or legal liability and agrees to compensate the LIYC for any harm, liability, or loss arising out of this agreement. The Membership Contract is understood to be from the date of application approval to December 31st of the contract year. This agreement is for one year only and it is agreed that LIYC is not obligated to provide the Member with services outside of the listed dates. All active members in good standing will be automatically renewed for the upcoming season at the applicable membership rate and terms offered. Members who choose not to continue their membership must submit a membership resignation letter prior to December 15th of the upcoming year.

OPERATING SEASON & HOURS:

In season (Memorial Day ~ September) The Club will be open weekends starting Friday afternoon of the Memorial Day Weekend. The club transitions to a seven day a week schedule coinciding with the last day of the school year in June and runs through the Monday of Labor Day weekend.

In season hours of operation will be posted in the Spring and may fluctuate based on staffing requirements. Posted days/hours are weather permitting and at the sole discretion of the LIYC management)

Off season (October ~ April) the club hosts holiday themed events, monthly social gatherings, and the clubhouse is available for private parties/catered events.

Note: Specific areas of the club will be subject to closure during private member events. Members will be notified of the closure via email.

APPLICATION FEE:

A new member application fee of $750.00 is to be paid for each member candidate at the time of application. If a Member chooses to not renew their membership for a term, and they would like to return later, they must reapply and pay another initiation fee just like a new member.

FACILITY DINING:

All food and beverages consumed at the Club must be furnished by the Club unless otherwise permitted. All alcoholic beverages must be purchased in accordance with New York State Liquor Laws. Alcoholic beverages will not be served, sold, nor permitted to be consumed at the Club in any manner prohibited by state or local law. The Club reserves the right, in its sole discretion, to refuse service to a member or guest when that member or guest appears to be intoxicated.

GUESTS:

Guests will be entitled to use the Club facilities only in accordance with the privileges of the Membership of the sponsoring Member and upon payment of the daily guests fees. All guests using the Club amenities must be registered and accompanied by the sponsoring Member. The sponsoring Member will be charged a $10 per weekday and $15 per weekend/holiday guest fee for use of the club amenities. A particular individual guest is permitted to be a guest for a maximum of 3 days per membership term. The sponsoring Member shall be responsible for all charges incurred by the guest. The sponsoring Member is also responsible for the conduct of their guests. If the guests conduct is unacceptable, the sponsoring Member shall have their guests leave the Club immediately.

CREDIT LIMIT:

All Members have a credit limit of $1,000.00 per month. If a Member reaches $1,000.00 before the end of the month, the Member must pay the balance via cash, check or with a credit card online before the Member may resume account charges. If no form of payment is received, account charge privileges will be suspended until the balance is paid in full.

DEPENDENT CHILDREN:

A Member's immediate family, included in the Membership, will be entitled to use of the LIYC facility on the same basis as the Member. A Member’s dependent children are defined as unmarried, under the age of 25 who are living at home, attending school on a full-time basis, or serving in the military.

CCTV:

Members and their guests be aware that for safety reasons, we use CCTV surveillance across our property and buildings

INDEMNITY:

The Member shall indemnify and save harmless LIYC from and against any and all liability, damage, penalties or judgments, including attorneys’ fees, arising from injury to person or property sustained by anyone in and about the premises including Member’s agents, servants, employees, contractors, guests or invitees. Member shall, at the Member's own cost and expense, defend any and all suits or actions (just or unjust) which may be brought against LIYC or in which LIYC may be impleaded with others upon any such above mentioned matter, claim or counter claims, except as may result from the acts set forth in the following paragraph.

MEMBERS LIABILITY:

Except for its affirmative acts or negligence or the affirmative acts or negligence of its officers, agents, servants, employees or contractors, LIYC shall not be responsible or liable for any damage or injury to any property, or to any person or persons, at any time on the licensed premises including any damage or injury to Member.

REFUNDS:

Upon agreement of this contract by the Member, the LIYC is in no way obligated to refund any sum of deposits and/or payments toward the agreed upon Membership fee set forth above in whole or in part it.

RENEWAL:

The term of this License is only for the year set forth above. Member expressly acknowledges that Member has no right to renew or extend this License. Any further grant of a Membership shall be at LIYC’s sole discretion and upon such terms and conditions, as LIYC shall deem appropriate. All active members in good standing will be automatically renewed for the upcoming season at the applicable membership rate and terms offered. Members who choose not to continue their membership must submit a membership resignation letter prior to January 15th of the upcoming year.

LEGAL FEES:

If Member shall at any time default hereunder or violate any term or condition of this License, and if LIYC shall, in connection therewith, retain its attorney to institute any action and/or render any other professional services, then Member will reimburse LIYC for the reasonable expenses of attorneys’ fees and disbursements incurred by LIYC.

SUBORDINATION:

This Agreement and all rights of the Member hereunder are and shall be subject and subordinate to the lien of any mortgage or mortgages which now or may hereafter affect the fee title of the licensed premises and rights hereby created, and to any modifications, renewals, extension or replacements of such mortgage or mortgages.

 

 

RULES

A. Members are defined as those whose names appear on the membership contract.

B. Parents/guardians are responsible for the conduct of their children at all times. Children ages 12 and under must be accompanied by an adult while on LIYC property

C. Any tents or shaded structures apart from umbrellas are not permitted at the beach area

D. LIYC permits smoking and Vaping in two designated Outside Bar areas. All other outside areas are nonsmoking areas. Smoking is not permitted inside any structure on the property.

E. Members must register and accompany guests at all times while on club property. Members are responsible for acquainting their guests with the Club rules, regulations, and are responsible for the conduct of their guests

F. Members are responsible for all charges incurred by their guests

G. All chits must be signed upon purchase of a food or beverage item

H. Members are liable for all charges against their account

I. Outside food and/or beverage is not permitted with the exception of dietary medical needs. All organized events i.e., parties and social gatherings, must be coordinated through club management.

J. As per NYS law, anyone under the age of 21 is not allowed to sit at the bar for any reason

K. No sale of alcohol may be made for consumption off the premises

L. Members and guests are asked to use common sense when interpreting the dress code

M. No food of any kind may be brought into the pool area per Suffolk County Health Regulations. Food may be eaten in the designated areas only

N. Only water in clear plastic bottles and drinks served by the LIYC in plastic cups are permitted on the pool deck. Absolutely no glass bottles and/or glasses allowed in the pool area.

O. Members must sign in and include their guests names along with signing a chit where applicable

P. Disorderly conduct will not be tolerated. Disorderly members or their guests will be removed from the Club property

Q. Any members that are not in good standing of the Club will have their membership suspended until further notice

R. The display of political and/or social messaging posters, signage, flags, pennants, etc. is strictly prohibited anywhere on property – including but not limited to the marina and boats within the marina.

S. Member shall be responsible for the safety and acts of all family members, guests and invitees

T. All dogs must be kept under leash and cleaned up after. Dogs that are a nuisance to other Members will be asked to leave.

U. The consumption of alcoholic beverages not purchased from the LIYC is strictly forbidden on the mainland property of the Long Island Yacht Club.

V. No outside food and/or catering may be brought in and/or delivered to the LIYC without prior written consent from Management. The LIYC can accommodate catered food by request.

W. No unreasonable noise is permitted that might be annoying or offensive to others. Quiet hours coincide with the Village of Babylon noise ordinance policy. No loud music or unreasonable noise during the quiet enjoyment hours of 10pm to 9am.

X. Members must Treat LIYC employees in a respectful manner, shall not reprimand, direct, or verbally, physically or otherwise abuse any LIYC employee. Any complaints or suggestions about employees are to be made in writing addressed to the appropriate member of the Management team.

Y. Members shall not engage in the excessive use of alcohol, acting in a way that becomes a public nuisance or creates a public disturbance is prohibited.
